Notice to Members

The AEC has provided the Victorian Branch with a Post-election report from the recently concluded Branch Elections.

The report identified a difficulty in applying the UFUA Rules in relation to the dates at which steps in the ballot should be taken as follows:

The following rules were difficult to apply:

Rule 27 (10)

(a)  the date for the posting of ballot papers shall be 21st April.

(b)  the time on which the ballot closes shall be 5pm on 7th May

Sub-rules 27(10)(d) and (e) were difficult to apply because they do not allow time for the ballot period. Rule 27(10)(d) of the UFUA Rules states that the date for the posting of the ballot papers shall be 21 April, however 21 April 2024 was a Sunday and rule 27(10)(e) states that the time on which the ballot closes shall be 5pm on 7 May.

Practical considerations required the AEC to open the ballot for at least twenty-eight (28) days. This is the minimum reasonable time for the delivery of mail and for electors to complete and return their ballot packs. For this election a six week ballot period was timetabled with ballot opening on 22 April 2024 and closing on 3 June 2024.

This is largely a problem brought about by Australia Post changing its delivery of mail.

The Branch has written to the AEC advising it that it has written to the UFUA National Office about the difficulty identified in the report.
